Because common-law partner status does not give rise to the granting of support for the benefit of a spouse in the event of a breakup, it is important to provide for an agreement to that effect if this is the parties’ intention. Please also note that, since June 30, 2025, the new parental union regime under the Civil Code of Québec governs certain patrimonial consequences for common-law partners who have a child together. Four-way negotiation is always conducted in a spirit of collaboration, with collaborative lawyers seeking to encourage both dialogue and the amicable settlement of the matter. Family mediation is a voluntary and confidential process that allows spouses, with the assistance of an accredited and neutral mediator, to negotiate a fair agreement regarding the consequences of their breakup, including child custody, support, partition of patrimony, and other related matters. What is the difference between divorce and separation?

Divorce legally ends the marriage, whereas legal separation maintains the marital bond while allowing spouses to live separately, with effects on support obligations, custody and the partition of property. The choice between the two depends on your personal and religious situation. In addition, common-law partners may file a claim for unjust enrichment.

Are common-law partners automatically entitled to support?

common-law partners status does not give rise to the granting of support for the benefit of a spouse in the event of a breakup. However, child support remains applicable, and spouses may enter into an agreement to govern their financial obligations. Since June 30, 2025, the new parental union regime provides additional protection for common-law partners who have a child together.

My corporate structure is very complex. How will tax matters be handled during the partition?

Our team is experienced in dealing with complex corporate structures and related contentious issues. You will therefore be well advised with respect to the partition of property and the tax impacts to be limited.

What distinguishes mediation from collaborative law?

In mediation, an accredited and neutral mediator helps spouses negotiate their agreement directly, without each spouse necessarily being accompanied by a lawyer at every meeting. In collaborative law, each spouse is represented by their own lawyer trained in this approach, and all four parties commit to negotiating outside of court. Both approaches favour amicable settlement.
